3. At the time of his death, James Guy McKeever, Jr., was widowed; an official copy of both the Certificate of Marriage to Dorothy Loraine Jennelle and Death Certificate of Dorothy Lorraine McKeever are attached hereto as Exhibit “B” and Exhibit “C,” respectively, and are incorporated herein by reference.
4. At the time of his death, James Guy McKeever, Jr., was survived by his children Beverly Kay McKeever, James Guy McKeever, III, and Paul Michael McKeever; an official copy of the birth certificates of Beverly Kay McKeever, Paul Michael McKeever and James Guy McKeever, III, are attached hereto as Exhibit “D,” and Exhibit “E” and Exhibit “J”, respectively, and are incorporated herein by reference.
5. Subsequently, Paul Michael McKeever departed this earth on February 24, 2021, unmarried and without any children; an official copy of Paul Michael McKeever’s death certificate is attached hereto as Exhibit “F” and is incorporated herein by reference.
6. Brian Lapchak, Esq., is or will be the Personal Representative of the Estate of Paul Michael McKeever in Dorchester County, South Carolina, Probate Court Case Number 2025ES1800111.
7. Thereafter, James Guy McKeever, III, departed this earth on October 25, 2022, divorced and with two children, James Guy McKeever, IV and Robert Kyle McKeever, surviving him; an official copy of the death certificate of James Guy McKeever, III, and a copy of the birth certificates for James Guy McKeever, IV are attached hereto as Exhibit “G” and Exhibit “H,” respectively, and are incorporated herein by reference. A birth certificate for Robert Kyle McKeever will be subsequently filed once received from Robert Kyle McKeever.
8. Brian Lapchak, Esq., is or will be the Personal Representative of the Estate of James Guy McKeever, III, in Dorchester County, South Carolina, Probate Court Case Number 2025ES1800112.
9. At the time of his death, James Guy McKeever, Jr., was seized in a One Hundred Percent (100%) interest in fee simple title to certain real property situated in Dorchester County, South Carolina, located at 303 Ashford Circle, Summerville, South Carolina 29485; a copy of the deed of the subject property is attached hereto as Exhibit “I” and is incorporated herein by reference.
8. The Estate of James Guy McKeever, Jr., was never the subject of probate administration in Dorchester County, South Carolina, or in any other jurisdiction, and judicial determination as to those persons who are heirs-at-law is necessary to clear title to the real property interests he owned.
9. More than ten years have passed since the death of James Guy McKeever, Jr., and his estate is ineligible for probate administration under the laws of this jurisdiction.
10. Petitioners are therefore entitled to an Order of the Court declaring that James Guy McKeever’s heirs-at-law at the time of his death were his children, Beverly Kay McKeever, Paul Michael McKeever and James Guy McKeever, III; and that the interest held by Paul Michael McKeever and James Guy McKeever, III, shall be transferred through their Estates.
WHEREFORE, Petitioner prays unto this Honorable Court for an Order:
(1) Determining that the heirs-at-law of James Guy McKeever, Jr., at the time of his death, were his children, Beverly Kay McKeever, Paul Michael McKeever and James Guy McKeever, III; and that the interests held by Paul Michael McKeever and James Guy McKeever, III, shall be transferred through their Estates.
(2) Granting such other and further relief as this Court may deem just and equitable.

Furthermore, as stated in the affidavit of Petitioners’ Attorney, I find that EDWARD MERRITT FARMER, JR., Esquire, has no interest adverse to these persons; he is an attorney at law, licensed to practice law in the State of South Carolina, and is fully competent to understand and protect the rights of these persons; he has no interest adverse to these persons; he is not connected or associated with Payne Law Firm, LLC, the attorney who represents the Petitioner; he is not the attorney for the Petitioner; and because he is an attorney, and agrees, in accordance with Rule 17(d)(2), SCRCP, that it shall not be necessary that he be represented by an additional attorney, and he further acknowledges that Payne Law Firm, LLC, attorney for the Petitioner, shall not and do not represent him; and further because he consents to act as such Guardian ad Litem of these persons.
IT IS THEREFORE ORDERED that the said EDWARD MERRITT FARMER, JR., Esquire, be, and he is hereby designated and appointed Guardian ad Litem Nisi, which appointment shall become Absolute upon the expiration of thirty (30) days from the date of service of this Order, for said adults, infants, persons under disability or incompetents, if any, persons in the military service of the United States, distributes, issue, executors, administrators, successors, or assigns of any of the named defendants, if they be dead, and of JAMES GUY MCKEEVER, JR. and also all other persons unknown claiming any right, title, estate, interest in, or lien upon the estate(s) described in the Petition, and being designated by fictitious names of JOHN DOE and JANE DOE and is hereby authorized to appear and defend said action on behalf of said unknown Respondents, unless said unknown adult Respondents make appearance or the unknown minor Respondents, other unknown Respondents under legal disability, if any, or either of them shall within thirty (30) days after the service of a copy of this Order upon them, exclusive of the day of service, as herein provided, procure to be appointed for them an Attorney or Guardian ad Litem, for the purposes of this action;
