Fire Department Wins Judgement In Charges

A summary judgement has been granted in favor of the Blaney Volunteer Fire Department in a suit filed by Raymond E. Ferrell of Elgin.

In a suit against the department, Ferrell asked $57,000 in damages after he said he was hit by a fire truck during a parade July 1, 1979. The judgement was granted before the case came to trail.

Rolly Jacobs, who represented the fire department, said the late Curtis Pierce, who was then fire chief, was leading a procession that included a fire truck driven by Paul Grooms. According to Jacobs, Ferrell maintained the truck pulled off the road and hit him. Grooms disagreed.

The fire department had no insurance on the truck because it was given to the department by the county, although the title was never transferred. The department now is incorporated and carries insurance on all its vehicles.
